The White House is already playing word games. SCOTUS called it a tax, and now Jay Carney, carney barker extraordinaire, is trying to call it something else.

Obamacare still unconstitutional?

One of the commenters over at volokh thinks that because the mandate is still unconstitutional, the penalty/tax/whatever can't apply. Can the government tax something that is unconstitutional?
